If you enroll in paid software services through Powervox, your use of those services will also be governed by a separate Software License Agreement, Statement of Work, and, where applicable, a Business Associate Agreement (BAA). In the event of any conflict, those agreements will take precedence over these Terms.

Your use of our site and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

5. No Medical Advice

You agree to indemnify, defend, and hold harmless Powervox, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the site or services, or your violation of these Terms.

We may suspend or terminate your access to the site or services at any time and without notice if we believe you have violated these Terms or applicable law. You may also terminate your use of the site at any time.

12. Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet outages, or governmental restrictions.

13. Changes to Terms

We may update these Terms from time to time. The most current version will be posted at www.powervox.com/terms with the effective date indicated above. Continued use of the site or services after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Johnson County, Kansas.

The following sections will survive any termination of these Terms: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Survival.
